The much-anticipated decision in the Gibson v Maritime New Zealand Appeal has upheld the original conviction and sentence - raising the questions of what this means for other CEOs. 

The ruling underlines the significant expectations on CEOs as Officers, and that these go beyond "good intent" and require strong leadership and visible safety advocacy. CEOs are expected to actively test and verify that health and safety systems work in practice—not just exist on paper. CEOs can rely on the expertise and judgement of others, but only when you have made proper enquiry, tested that advice, and followed up to ensure issues are actually addressed.  

The High Court's appeal decision means we now have clear case law to inform our leadership and governance practices.
