With the decision from the District Court in the Maritime NZ v Gibson case we recognise many Forum members will be keen to learn more about what this means - the first time a CEO of a major New Zealand company has been personally convicted of an offence under the Health and Safety at Work Act 2015 (HSWA).
Judge Bonnar found former CEO of Port of Auckland Tony Gibson guilty of falling to comply with his duty to exercise due diligence to ensure Port of Auckland complied with its duties under HSWA. This is a case brought by Maritime New Zealand after the death of Pala’amo Kalati at the Port in 2020.
